SUMMARY:
An action was brought by the City against B.R.W. Contracting, Inc., to recover damages arising from sewer backups in several houses during construction of the Overlea Street and Stevenson Drive gravity sewer improvements. This construction was conducted under the auspices of a contract between B.R.W. and the City entitled “Overlea Street and Stevenson Drive Gravity Sewer Improvements (03-0037-UT).” The damages to the houses referred to above were paid by the City and the City seeks reimbursement from B.R.W.
The proposal would provide for the settlement of all claims in exchange for payment of $150,000.00.
