Approve the Right-of-Way Vacation request from Clearwater Village, L.C. for portions of city rights-of-ways, as recorded in Plat Book 13, page 59 in the Public records of Pinellas County, Florida consisting of the Mall, Lantana Avenue, Idlewild Drive, Evergreen Avenue, Gardenia Court, Woodlawn Terrace, No Name Streets, and Shore Drive, abutting Tract B, Clearwater Village Phase 1, as recorded in Plat Book 126, Pages 6-8 of the Public records of Pinellas County, Florida, and pass Ordinance 9889-26 on first reading.

SUMMARY: 

The purpose of this vacation is to accommodate the Applicant's expected replat changes. The City ROWs are unimproved.

 

Approval is conditioned upon the Applicant granting to the City an executed Utility Easement over existing water facilities.

 

Approval is conditioned upon the Applicant presenting to the City an executed and recorded Ingress, Egress, and Access Easement granting Edmund S. Whitson the legal right to cross the Applicant's property for access.
