SUMMARY: 

The City of Clearwater hired NewGen Strategies and Solutions to prepare a feasibility study to advise the City as to the infrastructure needed and probable cost for the municipalization of electric utilities.  This study followed the conclusion of a 30-year franchise agreement with Duke Energy.  The City and Duke Energy have engaged in negotiations for a new franchise agreement.

 

Due to the specific nature of this matter, the former City Attorney hired GrayRobinson to assist the City with these municipal law matters.  Since August 2024, the City has spent approximately $91,000.00 in legal fees for this matter, with $50,426.98 in Fiscal Year 2025 and $40,568.93 in Fiscal Year 2026.

 

The City Attorney’s Office is requesting an increase of an additional not-to-exceed amount of $100,000.00.

 

This procurement is exempt from bidding pursuant to Section 2.563(1)(g), Clearwater Code of Ordinances.

 

APPROPRIATION CODE AND AMOUNT:

A budget amendment may be needed in cost code 0109600-530100, Professional Services, to fund this contract. The operating budget of the City Attorney’s Office is funded by General Fund revenue.
