Approve Temporary Right of Entry (ROE) Agreement with CSX Transportation, Inc., requiring indemnification, in support of the new City Hall project (22-0019-EN), and authorize appropriate officials to execute same. (consent)

SUMMARY:
CSX requires approval of a Temporary ROW Agreement for construction activities to commence in their easement. CSX has a 35.5’ easement over the railroad tracks on East Avenue in downtown Clearwater. As part of the new City Hall project site improvements, the existing curb will be removed and replaced, and the construction fence moved a few feet within the CSX easement to safely enable construction of the proposed improvements. A portion of this existing curb is withing the CSX easement.
Engineering is in process of negotiating with CSX to lower their proposed $92,987 in anticipated fees. A $24,500 flagging fee for up to 35 days is included at a per day rate. The City Hall work along the edge of the CSX easement is anticipated to take 15 days or less, hence over 50% of that fee will be returned to the city.
APPROPRIATION CODE AND AMOUNT:
Funds are available in capital improvement project ENGF220001, New City Hall, to fund fees associated with this agreement. This project is funded by revenues from the General Fund and Penny for Pinellas.
