Body

SUMMARY:

The City of Pinellas Park and Clearwater Fire & Rescue (CFR) would like to enter into a cooperative agreement to allow the Clearwater firefighters access to use the City of Pinellas Park Fire Training Facility during January 1, 2026 - December 31, 2027, 0700hrs - 2300hrs. This agreement shall remain in full force and effect until terminated by any party hereto.

The City of Pinellas Park owns and operates a Fire Training Facility, which includes a drill tower with two Class A Fuel burn rooms for live fire training, located at 11350 43rd St. N. Clearwater, FL 33762, which will be used to conduct training associated with structural firefighting and other related activities. Using Pinellas Park’s training facility will allow CFR firefighters to be exposed to a different facility layout and burn activities.

CFR agrees to repair or replace any damage to any real or personal property of the City of Pinellas Park caused by the actions or omissions of CFR’s officers, officials, employees, agents, and participants in the training held at the Training Facility.

The City of Pinellas Park has requested that CFR agree to the terms and conditions outlined in the Indemnification and Hold Harmless Agreement between the City of Pinellas Park and Clearwater Fire and Rescue. Additionally, the property manager has requested that CFR hold harmless the City of Pinellas Park from and against any and all loss liability, damage, cost or expense arising out of or related to CFR’s use of the property.

Nothing in the agreement, however, shall be deemed a waiver of the limitations on liability contained in Section 768.28, Florida Statutes, or the doctrine of sovereign immunity.

There are no costs associated with this Hold Harmless Agreement.
