Approve an ordinance of the City of Clearwater, Florida, vacating city right of way, alley, drainage and utility easements as more particularly described and recorded in the Bay View City Subdivision Plat Book 9, Page 43 and the abutting Bayview Terrace Subdivision as recorded in Plat Book 12, Page 63 of the Public Records of Pinellas County; providing severance; providing an effective date, and pass Ordinance 9888-26 on first reading.

SUMMARY: 

The applicant has submitted the proposed vacation request in support of the redevelopment of the abutting parcels under their ownership.

 

The area to be vacated includes improved and unimproved portions of right of way including Tennessee Avenue Blocks 3 & 6, the unimproved adjacent portion of Bay Street Blocks 6 & 7, the non-named unimproved 16’ foot Alley in Block 6, as well as an improved portion of Carolina Avenue, and a drainage and utility easement.  

 

The aforementioned improved portions of right of way are not constructed to city standards, and the City has not performed or incurred any significant maintenance expenses over these substandard roads.  The platted road system of Bay View City Subdivision was never constructed as indicated on the plat, and the City has previously vacated other right of way easements in this area to reflect the actual development conditions.  

 

The proposed vacation includes the condition that easements be conveyed to cover any utilities as necessary upon reconfiguration of the land.

 

Public Works staff has reviewed the request and recommends approval.
