Approve an agreement with Bryant Miller Olive P.A. for legal services and representation of the City in The Nash Keys FL, LLC v. City of Clearwater, Case No. 26-005622-CI and authorize the appropriate officials to execute same.

SUMMARY:
The Nash Keys FL, LLC is a business located in Downtown Clearwater that is asserting a cause of action against the City for an injunction and judicial declaration pertaining to the vacation of a right of way on the southern portion of Garden Avenue pursuant to Ordinance 9907-26.
The City Attorney’s Office recommends retaining Bryant Miller Olive to represent the City. Bryant Miller Olive has represented the City as outside counsel in various aspects of local government law for more than 20 years. This agreement authorizes the City Attorney to approve legal fee invoices in this matter up to the not-to-exceed amount of $100,000.00.
This agreement is exempt from bidding pursuant to Section 2.563(1)(g), Clearwater Code of Ordinances.
APPROPRIATION CODE AND AMOUNT:
Operating funds are available in cost code 0109600-530100, Professional Services. The operating budget of the City Attorney’s Office is funded by General Fund revenue.
